Although the DATE FOR COMPLETING CERTIFICATION HAS BEEN EXTENDED as of June 18, 2010, contractors MUST STILL ADHERE to ALL LEAD-SAFE PRACTICES in the RRP rule. (This new federal regulation carries fines of up to $37,500 per violation, per day.)

Who is Affected?

The Lead-Based Paint Renovation, Repair and Painting Program (RRP) affects contractors, building and property managers, and others who work with lead-based paint surfaces:

This legislation applies to:

• Anything greater than a six-foot square area of any lead-painted surface.
• Any of the following built before 1978:
  • houses
• apartments
• nursing homes
• hospitals/buildings where children or pregnant women are present, and
• child-occupied facilites such as schools and day-care centers

• Both exterior and interior surfaces.

It is imperative that your painting contractor understands these new regulations and the impact they may have on your building maintenance.

Mandatory Certification

Painting and property management firms (and employees doing the work) MUST be EPA-Certified and trained in the use of lead-safe work practices.

Any painting and maintenance work MUST BE PERFORMED in ACCORDANCE with EPA Lead-Based Paint Renovation, Repair and Painting Program standards.

Some of these standards include:

• There must be documentation verifying as a contractor you have informed the occupant regarding this legislation.
• You must maintain written documentation of your lead-safe practices in accordance to EPA specifications.
• You must have approved signage posted during work.
